In New Jersey, your employer’s insurance carrier usually selects your treating physician. However, you can request a change through your adjuster or ask for a second opinion. In emergencies, you may see any doctor immediately.

A denial can often be appealed. Review your denial letter for specific reasons and consider filing a formal claim petition with the NJ Division of Workers Compensation. You typically have two years from the date of injury to file an appeal.

While not required, a lawyer is highly recommended if your claim is denied or if you have a permanent disability. In New Jersey, workers’ comp attorneys only get paid if you receive an award, with fees set by a judge—so there is no upfront cost to you.
